Container Service Agreement and Release of Liability
This Container Service Agreement and Release of Liability (“Agreement”) is entered into between Wasatch Front Waste & Recycling District (WFWRD) and the undersigned owner, landlord, or duly authorized representative ("Participant") of the below identified subject property requesting the temporary placement of a container in accordance with the following terms and conditions.
This Agreement applies to all WFWRD container programs, including but not limited to:
  • Seasonal Container Reservation Program (SCRP)
  • SCRP cancellation waiting list placements
  • Any other containers loaned or rented from WFWRD
Participant Eligibility & Authority
I affirm that I am either: • the owner of the property; • the landlord of the property; and/or • a duly authorized representative acting on behalf of the service account holder or property owner.
I represent that I have full authority to accept placement of the container and to bind the service account holder/property owner to the financial and operational responsibilities outlined in this Agreement. The WFWRD service account holder and/or property owner remains ultimately responsible for all charges, damages, contamination, Prohibited Materials, and violations associated with the container, regardless of who schedules or uses it.
Compliance with WFWRD Rules
I acknowledge that participation in any container program offered by WFWRD is subject to all current WFWRD policies, procedures, and program rules. Failure to comply may result in denial of service, removal of the container, and additional charges as permitted by District policy.
Administrative & Scheduling Terms
  • Completing this Agreement does not guarantee container availability or service.
  • Delivery and pickup dates are subject to availability, routing, weather, and operational constraints.
  • For SCRP waiting list requests, placement is first-come, first-served as availability arises, and notification will be provided by WFWRD.
Placement Requirements
I understand and agree that:
  • Containers serving residential properties shall be placed wholly on private property, on level and stable ground, and must not obstruct or encroach upon sidewalks, streets, or public rights-of-way. NO EXCEPTIONS.
  • If adequate space, safe placement, or sufficient ingress/egress to place the container is not available, the container will not be delivered.
  • Once delivered, containers and/or trailers may not be moved or repositioned by the Participant or any third party. Unauthorized movement of a container or trailer may result in additional charges and liability for any resulting damage.
  • Service may be delayed, skipped, or rescheduled if access to the container is obstructed or if site conditions are unsafe, including snow, ice, parked vehicles, animals, or other conditions.
Loading & Weight Restrictions
I agree to comply with all container/trailer loading requirements, including:
  • The container must not be filled above the maximum load line or top rail
  • No more than 24 inches of heavy materials including concrete, gravel, rock, sod, or dirt
  • Materials must be evenly distributed within the container/trailer
  • Light-weight materials subject to windblown scattering or littering will be secured during loading and throughout temporary storage while the container is on my property
If a container is overloaded or improperly loaded, I agree to remove or adjust excess material upon request. Final determination of acceptable load limits is at the driver’s discretion.
* WFWRD staff will not collect or remove material placed outside the container or at the curb.
Acceptable & Prohibited Materials
The primary purpose of WFWRD’s bulky waste Seasonal Container Reservation Program (SCRP) is to provide removal services from residential properties for large, heavy, or other items that are too big to fit inside standard trash bins.
I agree that the container will be used only for residential-generated household waste and not for materials generated by commercial, contractor, or industrial activities.
The following materials are strictly prohibited (“Prohibited Materials”) and may not be placed in or around the container/trailer.
  • Tires (of any size or quantity)
  • Hazardous, radioactive, toxic, or other regulated wastes, including but not limited to asbestos, solvents, paints, hydrocarbons, antifreeze, pesticides, herbicides, propane tanks, gasoline, freon, batteries, fuel/oil products of any kind, compressed gases, polychlorinated biphenyls (PCBs), mercury or mercury containing devices, uranium mill tailings, and biohazardous or infectious laboratory/medical waste
  • Materials contaminated with or used in the production of methamphetamines
  • Ammunition, firearms, or explosives
  • Engines, transmissions, or other items that may pose risks to human health and the environment (e.g., catalytic converters, lead acid batteries, and lithium batteries, including electric vehicle batteries)
  • Barrels, drums, or containers over five (5) gallons in capacity unless they have been completely emptied, had the top removed, been cut or punctured to render them unusable, and contain no residue
  • Freon or freon-containing appliances
  • Animal carcasses and human excrement, remains, or body parts
  • Materials containing free liquids as defined in 40 CFR 260.10
  • Materials generated by commercial, contractor, or industrial activities
  • Materials that attract, generate, or harbor vermin or rodents, present conditions that are harmful to public health, or that create a fire hazard, safety hazard, odor, or nuisance
WFWRD reserves the right to refuse service or charge additional fees in accordance with the District’s fee schedule if prohibited items are identified or program rules are violated. WFWRD may immediately remove the container or terminate service if Prohibited Materials are identified, program rules are violated, or unsafe conditions exist.
Care, Damage, & Responsibility
  • I accept full responsibility for the container while it is located on my property or in my possession, including loss, theft, or damage beyond normal wear and tear. This responsibility includes, but is not limited to, damage resulting from fire, improper loading, Prohibited Materials, as well as damage caused by equipment operated by the participant, resident, tenant, or any third party not affiliated with WFWRD, including skid steers, track hoes, or backhoes.
  • WFWRD is not responsible for damage to driveways, pavement, landscaping, irrigation, private utilities, overhead wires, or other property conditions that are not readily visible or disclosed prior to delivery.
Release, Defense, & Indemnification
To the fullest extent permitted by law, Participant agrees to release, defend, indemnify, and hold harmless Wasatch Front Waste & Recycling District, its Board members, officers, employees, and agents from and against any and all claims, demands, damages, losses, liabilities, fines, costs, and expenses — including attorney fees — arising out of or related to the delivery, placement, use, misuse, loading, or removal of the container, except to the extent caused by the sole gross negligence or willful misconduct of WFWRD.
Participant Information
My below signature indicates that I have reviewed, fully understand, and agree to adhere to the terms and conditions of this Agreement. Additionally, I am the owner, landlord, or duly authorized representative of the below identified subject property and have the authority to enter into this Agreement. I acknowledge that this Agreement supersedes any former or existing container service agreement and may only be modified in writing by duly authorized representatives of Wasatch Front Waste and Recycling District and the Participant.
